By accessing and using memicards ("the Service"), you acknowledge and agree that:

• This is a personal/educational project built for learning purposes
• The Service is provided "as is" without any guarantees or warranties
• You use the Service entirely at your own risk
• We make no promises about reliability, uptime, or data persistence

2. No Warranty

We make no guarantees about:

• Uptime or availability — The Service may go offline at any time
• Data persistence or backups — Your data may be lost without warning
• Bug-free operation — The Service may contain errors or defects
• Continued maintenance — The Service may be discontinued at any time
• Security — While we use standard practices, we cannot guarantee absolute security

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We are NOT liable for any data loss, corruption, or unauthorized access
• We are NOT responsible for any damages (direct, indirect, incidental, or consequential) arising from use of the Service
• We are NOT liable for any interruption of service or loss of business
• You are SOLELY responsible for backing up your data

4. Data and Privacy

Data Collection

We collect and store:

• Account information (email, name) via Clerk authentication
• Flashcard data you create (words, translations, sentences, associations)
• Usage statistics and analytics via Google Analytics
• Review history and progress data

Data Storage

• Data is stored in a PostgreSQL database
• We use industry-standard security practices
• However, we provide NO GUARANTEE of data persistence or security
• You should regularly export your data using the export feature

Third-Party Services

We use the following third-party services:

• Clerk — Authentication and user management
• Google Analytics — Usage tracking and analytics
• Hosting provider — Infrastructure and data storage

Each service has its own privacy policy and terms of service.

5. User Responsibilities

By using the Service, you agree to:

• Use the Service responsibly and in compliance with applicable laws
• Not attempt to disrupt, exploit, or reverse engineer the Service
• Not use the Service for any illegal or harmful purposes
• Keep regular backups of your important data using the export feature
• Not hold us responsible for any data loss or service interruption

6. Account and Data Deletion

• You can delete your account at any time through the application settings
• Upon account deletion, your data will be removed from our database
• Data deletion may not be immediate
• We do not guarantee complete removal from all backups
• Export your data before deletion if you want to keep it

7. Changes to Service

We reserve the right to, at any time and without notice:

• Modify or discontinue the Service (in whole or in part)
• Change features, functionality, or pricing
• Update these Terms of Service
• Remove or restrict user access
• Shut down the Service permanently

We are not obligated to provide advance notice or migration assistance.

8. Free Service

memicards is currently provided free of charge. However:

• We may introduce paid features or subscriptions in the future
• Free access may be limited or discontinued at any time
• No refunds will be provided for any paid features (if introduced)

9. Intellectual Property

• You retain ownership of the flashcard content you create
• By using the Service, you grant us permission to store and process your data
• The memicards application, code, and design are our intellectual property
• You may not copy, modify, or redistribute the Service

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of your jurisdiction. Any disputes shall be resolved in the courts of competent jurisdiction.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Entire Agreement

These Terms of Service constitute the entire agreement between you and memicards regarding the use of the Service, superseding any prior agreements.
